Terms of Service

1. Acceptance of Terms
   By downloading, installing, or using the Robome AI app ("the App"), you agree to be bound by these Terms of Service, which form an agreement between you and Den Braver Beheer B.V. ("we," "our," or "us"). If you do not agree, do not use the App. The App is intended for users aged 17 and older.

2. Description of Service
   Robome AI lets you generate a video clip of yourself reimagined as a cyborg. You select one photo of yourself; the photo is sent to our own AI service on servers in the United States, which generates your video clip and returns it to you. The original photo is deleted immediately after processing completes, is used exclusively to fulfil your request, and is not used to train AI models. The App is available on iOS.

3. Age Requirement
   You must be at least 17 years old to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are a parent or guardian and believe a user under 17 has used the App, please contact us immediately.

4. License
   We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright, trademark, or other proprietary notices
• Distribute, rent, lease, or sublicense the App
• Use the App for any illegal or unauthorized purpose
• Use the App for commercial purposes without our written permission

5. Intellectual Property
   All content, features, and functionality of the App — including text, graphics, logos, icons, images, templates, and software — are owned by Den Braver Beheer B.V. and are protected by copyright, trademark, and other intellectual property laws.

6. Consent — Your Responsibility
   The App generates a video based on the likeness of the person in your photo. Before uploading any photo, you must ensure:

• You have the explicit consent of every identifiable individual whose face appears in any photo you upload
• You have the right to use the photo you submit (you own it or have appropriate permission)
• You understand that generating content featuring someone's likeness without their consent may violate applicable laws in your jurisdiction

We are not responsible for how you use generated content. Responsibility for obtaining consent lies entirely with you.

7. User Conduct
   You agree to use the App responsibly and in accordance with all applicable laws. You will NOT use the App to:

• Generate intimate imagery, or any other manipulated media, depicting a real, identifiable individual without that individual's consent
• Create content intended to harass, defame, threaten, or harm any individual
• Produce content designed to deceive others — including fake news, impersonation of public figures, or fraudulent media
• Violate any local, state, national, or international law or regulation
• Infringe on the intellectual property rights of any person or entity
• Upload content belonging to a minor in a sexual or exploitative context
• Attempt to circumvent content moderation or safety systems
• Attempt to gain unauthorized access to our systems or networks
• Use the App in any way that could damage, disable, or impair our services

Violations may result in immediate termination of your access and may be reported to law enforcement where required by law.

7A. User Content and Ownership
Photos You Upload

You retain all ownership rights to the photo you upload. By submitting a photo, you grant us a limited license to process it solely to fulfil your generation request. This license expires when processing is complete and the original photo is deleted.

Your Responsibilities

You are solely responsible for:

• Ensuring you have the right to use any content you upload
• Not uploading copyrighted material without authorization
• Not uploading illegal, harmful, or inappropriate content
• Complying with all applicable laws regarding content you create or share

Generated Videos

• Whether AI-generated content is protected by copyright varies by jurisdiction, and we make no claim that you do or do not own the copyright in a generated video
• Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, non-commercial, revocable license to use the generated videos for your own personal, lawful purposes
• "Non-transferable" means you may not sell or sublicense the license itself; it does not prevent you from sharing a video on your personal social accounts, provided the use stays non-commercial
• You are solely responsible for how you share or publish generated videos; any commercial use — including monetised accounts, advertising, or promotion — is prohibited
• We cannot guarantee uniqueness — similar inputs may produce similar results for other users

Content Removal

We reserve the right to investigate reports of misuse and to take action, including blocking access, where the App is being used to generate harmful or illegal content.

8. Coins
   How Coins Work

• Coins are purchased through the Apple App Store
• Each generation consumes a fixed number of coins, shown in the App before you confirm
• Your coin balance is stored on our servers and associated with your account or guest identifier
• Coins have no cash value, are non-transferable, and cannot be exchanged for money or any other asset
• We may change coin pack pricing or the number of coins consumed per generation; the current amounts are always shown in the App before you confirm

Failed Generations

• If a generation fails due to an error on our side, the coins consumed by that generation are automatically returned to your balance
• Coins consumed by a completed generation are non-refundable even if you are unsatisfied with the result

Purchased Coin Packs

• Purchases of coin packs are non-refundable except as required by applicable law or under Apple's refund policy
• Refund requests for purchased coin packs must be submitted to Apple through the App Store
• Abuse of refund policies may result in termination of service

Account Deletion

• If you delete your account, any remaining coin balance is forfeited, except where required by applicable law

9. AI-Generated Content Disclaimer
   AI Content Accuracy

• Generated videos are produced by AI and may not always match your expectations
• We do not guarantee quality, accuracy, or uniqueness of generated output
• AI output may contain artifacts or imperfections
• You are solely responsible for how you use generated content
• We are not liable for any decisions made based on generated content or for how generated content is perceived by others

Our AI Service

• The App's AI features run on our own AI service on servers we control. We are not responsible for delays caused by network conditions or factors outside our reasonable control.

10. Privacy
    Your privacy is important to us. Please review our Privacy Policy at https://www.robomeai.org/protocol/privacy.html, which governs how we collect, use, and disclose your information when you use the App.

11. App Store Terms
    These Terms are between you and Den Braver Beheer B.V., not Apple. Apple is not a party to these Terms and has no obligation with respect to the App. Your use of the App is also subject to Apple's App Store Terms and Conditions, including, where applicable, Apple's standard End User License Agreement ("EULA"). These Terms supplement, and do not replace, Apple's terms; nothing in Apple's terms shall be read to expand the personal, non-commercial license granted in Sections 4 and 7A.

12. Third-Party Services
    The App's generation features run on our own infrastructure, and we rely on no third-party AI provider. The App uses no third-party analytics, advertising, or tracking services. Apple provides sign-in and payment processing only. We are not responsible for the availability or performance of services outside our reasonable control.

13. Disclaimers
    The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the App will meet your specific requirements, be error-free or uninterrupted, or that generated content will meet your expectations. Some jurisdictions do not allow certain warranty exclusions, in which case they apply to the maximum extent permitted by law.

14. Limitation of Liability
    To the maximum extent permitted by applicable law, Den Braver Beheer B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App — including any harm caused by content you generate, share, or publish using the App. Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid us through the App in the twelve months before the claim arose. Some jurisdictions do not allow these limitations, in which case they apply to the maximum extent permitted by law.

15. Indemnification
    You agree to indemnify and hold harmless Den Braver Beheer B.V. from any claims, liabilities, damages, or expenses (including legal fees) arising from: your use of the App, content you generate or publish, your violation of these Terms, or your violation of any third party's rights, including consent and intellectual property rights.

16. Termination
    We may suspend or terminate your access to the App at any time without notice if you violate these Terms or if we are required to do so by law. You may stop using the App at any time, and signed-in users may delete their account using Delete Account in Settings. Upon termination, you must cease all use and delete the App from your devices.

17. Changes to These Terms
    We reserve the right to modify these Terms at any time. We will notify users of significant changes through app updates or other appropriate means. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

18. Governing Law
    These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the jurisdiction of the competent Dutch court, unless mandatory consumer law gives you the right to bring proceedings in your country of residence.

19. Severability
    If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
